Jack O’Loughlin and Ryne Takacs successfully defended a medical malpractice lawsuit against our client, a plastic surgeon, arising from an adverse drug reaction following breast reconstruction surgery. Smith Haughey vigorously defended the case through the completion of discovery and case evaluation. The case was scheduled for trial, and a victory for our client would have meant that the plaintiffs would face potential case evaluation sanctions approaching $100,000. Our client remained stalwart at all times, and we never made any settlement offers because of her strong convictions about the case. We were ready and willing to proceed and then, with trial looming, the plaintiffs voluntarily dismissed the lawsuit, obtaining no recovery. For our client, the only thing better than winning at trial was winning without having to go to trial.
