Court of Appeals Defense Victory – Propane Explosion

SHRR’s commercial client received a favorable outcome in a case arising from a propane system explosion. The plaintiffs sought more than $1 million, alleging negligence by our client for failing to perform a leak check during a propane delivery in Michigan.

After thorough discovery, the SHRR trial team filed a motion arguing that Michigan law does not impose a duty on propane delivery drivers to conduct leak checks and that the plaintiffs improperly relied on industry standards to establish a legal standard of care. Despite initial setbacks at the trial court and appellate levels, our team successfully contended that Michigan law imposes no such duty. The Michigan Court of Appeals ultimately reversed the trial court’s ruling and remanded the case for dismissal.
